Bullship Terms of Service

1. Acceptance of Terms

Welcome to Bullship (“we,” “our,” or “us”). By accessing or using our website, software, and services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Services (or, as we like to say, if you don’t like our peaches, don’t shake our tree).

2. Description of Services

Bullship provides cloud-based software solutions for pack-and-ship stores, including mailbox rental management, shipping label creation, shipment tracking, and related operational tools (the “Services”).

Our Services are intended solely to facilitate lawful shipping activities and store operations. We may modify, suspend, or discontinue any aspect of the Services at any time, and features may evolve over time (we’d sure hope so).

3. Eligibility and Lawful Use

To use the Services, you represent and warrant that you:

  • Are at least eighteen (18) years old and meet the minimum legal age to form a binding contract in your jurisdiction;

  • Have the legal authority to enter into these Terms, and if you are under the age of majority, your parent or legal guardian has reviewed and accepted them on your behalf;

  • Will use the Services only for legitimate, lawful purposes, including the legal shipment of products and documents;

  • Will comply with all applicable laws and regulations, including U.S. import, export, controlled substances, hazardous materials, and carrier-specific rules;

  • Have not had your access to Bullship permanently suspended or revoked.

If you are using Bullship on behalf of a business or other entity, you represent that you are authorized to bind that entity to these Terms. References to “you” include both the individual user and the entity.

4. Intermediary Role and Third-Party Carriers

Bullship acts solely as a software and technology intermediary. We do not provide shipping, courier, transportation, or delivery services. All shipping services are provided by third-party carriers (e.g., USPS, UPS, FedEx), subject to their own terms and conditions.

We do not control, endorse, or guarantee any carrier’s services, pricing, delivery times, or performance. Any shipment you create using the Services is subject to a separate contract between you and the selected carrier.

Risk of loss and title to shipments pass to you upon tendering the shipment to the carrier. You are solely responsible for filing claims with carriers for lost, delayed, or damaged shipments.

It is your responsibility to locate, review, understand, and accept the terms, conditions, and rules of purchase of any third-party courier you select for shipping through the Services. You are solely responsible for ensuring that all shipments, labels, and purchases comply with the applicable terms, conditions, and rules imposed by the selected courier, including restrictions on prohibited or hazardous items.

For example, if a courier does not permit the shipment of hazardous liquids, restricted materials, or certain goods, it is your responsibility to comply with those rules. Certain couriers may require you to affirmatively accept their terms and conditions before completing a shipment. For instance, when purchasing UPS shipping services through the Services, you may be required to accept applicable UPS terms and conditions in order to proceed.

If any shipment is delivered to Bullship by USPS, UPS, or any other courier for any reason—including if the courier determines that the shipment is undeliverable as labeled, noncompliant with carrier rules, or cannot be returned to the sender—Bullship may, in its sole discretion and without notice, take any action permitted by applicable law, including disposal or destruction of the shipment.

Bullship shall have no liability to you or any third party for any actions taken (or not taken) with respect to such shipments.

5. Account Registration and Security

Certain features require account registration. You agree to:

  • Provide accurate and complete information;

  • Maintain the confidentiality of your login credentials;

  • Be fully responsible for all activity occurring under your account.

Bullship is not responsible for unauthorized access resulting from your failure to safeguard credentials. You must notify us promptly of any suspected security breach.

6. Fees, Payments, and Additional Charges

Paid features may require payment. By subscribing or purchasing services, you authorize Bullship to charge your designated payment method.

You are responsible for:

  • All charges associated with your use of the Services;

  • Carrier-imposed adjustments resulting from incorrect weight, dimensions, classifications, or delivery requirements;

  • Any taxes, duties, customs fees, or similar charges.

If payments are declined or reversed, you agree to reimburse Bullship for any associated fees and reasonable collection costs.

7. Prohibited Conduct

You agree not to:

  • Use the Services for unlawful, fraudulent, or deceptive activities;

  • Ship prohibited or restricted items;

  • Reverse-engineer, copy, scrape, or exploit the Services or data;

  • Use bots, automated tools, or scraping technologies without written permission;

  • Interfere with the security or functionality of the Services.

Violations may result in immediate suspension or termination.

8. Intellectual Property

All software, content, trademarks, and designs related to Bullship are owned by or licensed to us.

You are granted a limited, non-exclusive, non-transferable license to use the Services solely for their intended business purpose. No ownership rights are transferred.

9. Termination

You may terminate your account at any time by contacting support.

Bullship may suspend or terminate access at any time, with or without notice, if we believe you have violated these Terms, misused the Services, or engaged in unlawful conduct.

Termination does not relieve you of payment obligations or liabilities incurred prior to termination.

10. Disclaimers

The Services are provided “as is” and “as available.”

To the maximum extent permitted by law, Bullship disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not guarantee uninterrupted operation, error-free performance, or carrier availability.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Bullship is not liable for shipping delays, lost packages, damaged goods, or carrier errors;

  • Bullship will not be liable for indirect, incidental, consequential, or punitive damages;

  • Our total liability will not exceed the lesser of $100 or the amount you paid to Bullship in the preceding twelve (12) months.

Some jurisdictions do not allow certain limitations, so these may not fully apply to you.

12. Indemnification

You agree to indemnify and hold harmless Bullship, its officers, employees, and partners from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from:

  • Your use of the Services;

  • Your violation of these Terms;

  • Your shipments or interactions with carriers;

  • Your violation of any law or third-party rights.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict-of-law principles.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
